摘 要：随着社会经济的快速发展，汽车已成为当今社会的主要道路运行工具，人们对汽车的需求增加导致二手汽车交易日趋活跃。而由于我国汽车市场受旧的政策和治理模式的影响，使汽车交易十分混乱，随之诉诸法院的案件也不断增多。如何处理此类案件，在法律界始终众说纷纭。笔者结合自己承办的案件，提出了在汽车交易中所存在的六个方面的法律问题，经逐一探讨后，作出如下观点：一、汽车买卖办理过户手续不是买卖合同生效的必备条件，不能因未办理过户手续就认定买卖合同无效；二、汽车买卖中物的占有与物权登记相冲突时，应根据登记所具有的物权公示效力及公信效力，保护善意第三人利益；三、汽车买卖未过户的产权归属，应具体分析物权变动和债权平等性问题，存在于同一标的上的物权效力先于债权；四、关于承包经营中的汽车买卖关系，从订立合同的目的、性质、内容和相关法律、法规的规定等方面分析，此类承包经营合同依法成立；五、汽车牌照是市场经济的产物，具有价值，可以转让；六、对于认定未过户的汽车交通事故赔偿责任主体，不应依据车辆所有权的归属来确定，应确认运行支配和运行利益的归属者为赔偿责任的主体。全文共约8000字。

Abstract: With the rapid development of economy, cars have become main means of transportation of the day. The increasing demand of cars leads to an active tendency of second-hand cars dealing.
But the old policy and management in cars market of our country make car dealing confusing. As a result ,the cases about cars dealing are increasing.
People have different opinions of how to deal with such cases.
According to some cases that I experienced, there are legal problems that exist in cars dealing. After studying them one by one, I present the following opinions.
1. Transferring procedures are not the essential conditions of becoming effective of contracts. Never consider it ineffective because of not transferring.
2. In case of conflict of who owns things and who has the right to register in cars dealing, we should protect the third person’s interest out of good will, according to effective proofs.
3. About the ownership of the untransferred cars, we should practically analyze the problems of the change of ownership and equality of creditors’ rights, and the effect of ownership should be favored over creditors’ rights if on the same conditions.
1. About cars dealing relationship in managing in the form of contract. From the aspects of the contracts’ purpose, nature, content and related laws and rules, such kind of contracts can be effective by law.
2. Car licenses are the result of dealing in economy life, so they can be transferred.
3. On judgement about who should be mainly responsible for the compensating for the traffic accident of cars that are not transferred, we shouldn’t judge by the ownership of cars but we should judge by who can benefit from the management of the cars.
